Kosejk J.: Will the New Decree Contribute to Woody Plants Protection?

The decree on the protection of woody plants and on issuing permits for cutting them down had been issued by the Ministry of the Environment of the Czech Republic (MoE CR) in late June 2013.

The piece of legislation had been preparing for a long time and it came into force on July 15. 2013. I comparison with the past, it defines some terms incl. prohibited interventions on woody plants, size and characteristics of woody plants which can be cut without permits or details on application for cutting down woody plants. It also sets the period when woody plants are usually cut. Nevertheless, most experts consider the decree as badly done, because despite some strengths, it also includes a lot of weaknesses and inaccuracies. It is suppose that some parts of the decree will be explained by a methodological recommendation on the implementation of some decree s provisions to be issued by the Moe CRs Department of General Nature Conservation and Landscape Protection. In developing the recommendation, the Nature Conservation Agency of the Czech Republic also participates. Moreover, the decree can be improved in more comprehensive way only by its amendment.
