Application of the Article No. 66 of the Act on the Protection of Nature and the Landscape – Limitat

Ustanovení obsažené v § 66 zákona č. 114/1992 Sb., o ochraně přírody a krajiny, ve znění pozdějších předpisů (dále jen zákon č. 114/1992 Sb.) upravuje jeden z nejsilnějších preventivních nástrojů ochrany přírody a krajiny.

The author summarises the experience of the Czech Environmental Inspectorate in application of the Article No. 66 of the Act No. 114/1992 Gazette on the Protection of Nature and the Landscape. She quotes the main judicature of Administrative Courts and principal interpretation of the Ministry of the Environment of the Czech Republic with res-pect to the above enactment. The article is one of the most important nature conservation and landscape protection tool, having a pronounced preventive character. Under the provision, the State Nature Conservancy authority is entitled to impose upon both natural and legal/juridical persons conditions for the execution of their acti-vities which could cause an unwarranted change in generally or specially protected parts of nature, or they may prohibit such activities. With respect to procedural questions related to the application of the legal tool, it always is the administrative procedure initiated by force of an official authority which the State Nature Conservancy authority is obliged to initiate, if it finds the reason by law. Within the administrative procedure under the Article No. 66, the anticipation can be issued in case of need. The decision imposing conditions for the execution of activities or for their prohibition is anticipatorily executable by law.

Activities permitted by other State Administration body can also be limited or prohibited. Therefore, imposing the conditions under the Article 66 during other procedures issuing permits or approvals by some State Nature Conservancy authorities is not correct.
