Providing Territorial Data in Nature Conservation and Landscape Protection

The authors present a new issue within the Building Act, namely providing with territorial data, which aims at the duty of the respective authorities to provide with relevant information as a background for elaborating planning documentation.

They pay a special attention to performing the duty by a data provider. On January 1, 2007, Act No. 183/2006 Gazette on Urban and Country Planning and Building Code as well as Ministry of Regional Development of the Czech Republic Decree No. 500/2006 Gazette on Planning Analytical Materials, Planning Documentation and Ways of Planning Activities Filing entered into force. Thus, some authorities within the Public Administration and private entities are obliged to provide procurers of planning analytical materials with territorial data. Within the State Nature Conservancy, all its levels, from the Ministry of the Environment of the Czech Republic to municipalities with authorized municipal (= local) office are in charge of implementing the Act, including the Agency for Nature Conservation and Landscape Protection of the Czech Republic (ANCLP CR). Most of the territorial data dealing with nature conservation are provided by the ANCLP CR’s Headquarters. Layers of Specially Protected Areas, European Community’s Natura 2000 network sites and memorial/veteran trees are managed as a part of the Nature Conservancy Central Register. Other territorial data are provided on the authority of the Ministry of the Environment of the Czech Republic. At present, all the territorial data are distributed as vectoral layers, elaborated for the whole area.
