The contribution aims at Act No. 167/Gazette on the Prevention of Environmental Damage and Its Remedying and Amendments of Some Acts which transposes Directive 2004/35/EC of the European Parliament and of the Council of 21 April 2004 on environmental liability with regards to the prevention and remedying of environmental damage into the Czech Republic legislation.
The article presents the basic principles (prevention, the “polluter pays” principle, restoration of the environment) and institutions of the new piece of legislation from a point of view of nature conservation and its relation to Act No. 114/1992 Gazette on the Protection of Nature and the Landscape, as amended later. The author particularly summarises the definition of environmental damage on protected wildlife species and natural habitat types, objective liability, preventive measures, remedial measures, State Administration performing in this field and related financial matters.
