Relationship between Nature Conservation and Forest Laws

The author aims at description and analysis of the authority of nature conservation law over forest law in the Czech Republic.

The article also includes reflections on and proposals for changes in both of them. In what is now the Czech Republic, the forest law has had a long tradition, because a forest act was passed in 1852 there. The first act on nature conservation came into force a century later, namely in 1956. The relationship between both the laws is the article's main topic. The author pays special attention to the conceptual tools included into the conservation law, particularly: the authority of the nature conservation law over the forest law, the former being a special one; the concept of law of the forest as a Significant Landscape Element, a tool of general nature conservation; forest management planning from the point of a view of nature conservation interests; ownership issues and aspects of property rights in nature conservation on forest lands. In the Czech Republic, nature conservation goals and tasks cannot be reached without some influences on the forest law because forests cover one third of the countrys whole territory and they also are the crucial land use/ecosystem type in Specially Protected Areas. Fortunately, the currently effective Act No. 114/1992 Gazette on the Protection of Nature and the Landscape, as amended later, offers a suitable solution. When possibly again amended, some suggestions made by the author would be applied there.
