On the Purpose of Establishing a Temporary Protected Area

Act No. 114/1992 Gazette on the Protection of Nature and the Landscape, as amended later, allows in its Article 13 to establish a Temporary Protected Area (TPA), protecting a site or an area with the unpredicted occurrence of important wild plant and animal species, minerals and palaeontologic findings. The area is declared for the fixed period set in advance, the repeated periods, as for the breeding/nesting season respectively. The State Nature Conservancy authorities have very often used to misapply the above legal tool. The TPA can be established only by the administrative decision, which is particularly addressed. Because the legal tool cannot limit land-use by subjects which have not been set in advance, movement of persons across the landscape or using the landscape for leisure, recreation and sport purposes cannot be controlled and regulated by declaring a TPA. The decision on establishing a TPA can limit landowners and renters in managing the area, but they are not obliged to act themselves for improving the state of nature.
