Contracts Governed by Public Law Pursuant to the Act on the Protection of Nature and the Landscape

Act No. 114/1992 Gazette on the Protection of Nature and the Landscape, as amended later, applies many latest administration law legal tools.

These particularly are a preliminary information, legal measures general character and contracts governed by public law. Before having been amended, the Act included three types of contracts governed by public law, namely on a protected area protected by a contract, contract on management measures in a Bird Area (pursuant to the above act, the term for the Special Protection Area, SPA under the Birds Directive) and contract on management of a land: the latter can be, in certain cases, combined with the contract on a subsidy paid to the land owner or the tenant. In its 5thPart, the latest amendment to the Act presents other two types of contracts governed by public law, aiming at species protection: a contract on management of a land inhabited by a Specially Protected Species and contracts which in given cases, being in the interests of nature conservation, replace statutory exceptions from the prohibitions for protection of specially protected wild animal and plant species. For entering into force, the above, so-called sub-ordinary contracts should be agreed by a third party, which in other cases shall be a juristic persons/party to an action.
