Šedina P.: Delisting of the Great Cormorant from the Specially Protected Species List in the Czech R

The Great Cormorant (Phalacrocorax carbo) has been still explicitly specified among wildlife species in Article 3, letter c) of Act No. 115/2000 Gazette on Providing Compensation for Damages Caused by Selected Specially Protected Animals, as amended later.

Nevertheless, the species does not meet the conditions pursuant Article 1, paragraph 1 and Article 5, paragraph 1 of the above act, because it has not been a Specially Protected Species. Thus, compensations for damages caused by the fish-eating bird cannot be paid more. The provision of Article 5, paragraph 1 explicitly states, that damages are compensated only when having been caused verifiably on the Czech Republic territory and only provided that the wild animal species has been specially protected under the specific law. Therefore, due to the delisting the Great Cormorant from the Specially Protected Species list, applications to receive compensation for the damage caused by the above wild bird can be submitted to the respective authorities only if the damage had been caused by March 31, 2013 at the latest. Pursuant to Article 8, paragraph 3, letter c) of Act No. 115/2000 Gazette, such an application to compensate the above specified damage shall be submitted to the respective Regional Authority/Administration by September 30, 2013 at the latest.
