nástroj k odstraňování konfliktů mezi ochranou přírody a hospodařícími subjekty
Zákon č. 115/2000 Sb., o poskytování náhrad škod způsobených vybranými zvláště chráněnými živočichy v platném znění (dále jen zákon 115), byl přijat v dubnu roku 2000. Má za cíl mírnit konflikt mezi zájmy ochrany přírody a vlastníky domestikovaných zvířat, rybníků, zemědělských či lesnických pozemků apod. Zákon umožňuje za splnění zákonných podmínek uhradit škodu, kterou způsobil na majetku vybraný zvláště chráněný živočich podle zákona č. 114/1992 Sb., o ochraně přírody a krajiny v platném znění.
Act No. 115/200 Gazette on Providing Compensation for Damages Caused by Selected Specially Protected Animals, as amended later, aims at reducing conflicts between nature conservation interests and those of private owners of domesticated animals, fishponds, agricultural or forest lands, etc.If legal requirements are met, the property damage caused by the selected wild animal specially protected under Act No. 114/1992 Gazette on the Protection of Nature and the Landscape, as amended later can be compensated. The article deals with competencies and ways how to apply for the compensation. Because of non-unified methods for evidencing the damage, the Agency for Nature Conservation and Landscape Protection of the Czech Republic has prepared, in collaboration with experts from other institutions, methods which sets up the unified way for calculating the compensation for damages.
